Agreement to these Terms
These Terms of Service (“Terms”) govern your access to and use of Maktby’s websites, applications, APIs, and related services (the “Service”). By creating an account, clicking to accept, or using the Service, you agree to these Terms and to our Privacy Policy.
If you do not agree, do not use the Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization, and “you” includes the organization.
The Service
Maktby provides a creative and operations workspace that may include, depending on your plan and permissions: AI-assisted generation and editing for images, text, and related media; galleries and asset libraries; domain and tooling features; social and messaging integrations (such as business inboxes, publishing, calendars, comments, and analytics); wallet, credits, or merchant features where enabled; knowledge bases; bio links and short links; administrative dashboards; APIs; and other features we make available from time to time.
We may modify, suspend, or discontinue features with reasonable notice where practicable. Some features depend on third-party platforms and may change when those platforms change.
Eligibility, accounts, and security
You must provide accurate registration information and keep it updated. You are responsible for activity under your credentials, including API keys and connected integrations. You must safeguard passwords and secrets and notify us promptly of unauthorized use.
- You must comply with applicable laws and third-party terms when using integrations (for example, platform developer policies and messaging rules).
- We may enforce role-based access, workspace boundaries, and technical limits (rate limits, quotas, and abuse protections).
Acceptable use
You may not misuse the Service. Without limitation, you agree not to:
- Violate laws or infringe intellectual property, privacy, or publicity rights of others.
- Generate, upload, or distribute malware, unlawful content, harassment, hate speech, non-consensual intimate imagery, or content that exploits minors.
- Attempt to probe, scan, or test vulnerability of the Service or other users’ accounts without authorization; interfere with or overload infrastructure; or bypass security or access controls.
- Scrape, crawl, or harvest data from the Service except through documented APIs and within permitted limits.
- Resell or redistribute the Service in violation of your agreement or use the Service to build a competing product by misappropriating our proprietary materials.
- Use AI features to produce deceptive impersonation, fraud, or illegal surveillance, or to violate platform policies of networks you connect.
We may investigate violations and cooperate with law enforcement where required.
Lawful use and Islamic values
We built Maktby so teams and creators can work with clarity, trust, and goodwill. You agree to use the Service only for lawful purposes and in a way that respects other people’s rights and dignity—there is no room here for illegal activity, fraud, or harm.
Many of our users also choose to keep their marketing, messaging, and creative work aligned with Islamic ethics: truthfulness, fairness, care for family and community, and staying away from what faith clearly discourages—such as deception, promoting vice, or content that offends modesty or encourages wrongdoing. We celebrate that intention and ask you to let those values guide how you publish, advertise, and communicate when they matter to you or your audience.
These Terms are not a substitute for qualified legal or religious advice in your country, and they don’t replace the rules of networks you connect. They simply set a friendly baseline we all share: follow the law, be honest, and don’t use Maktby to promote or produce clearly unlawful material or conduct. When in doubt, pausing to review—or asking someone you trust—is always wiser than rushing.
Your content and licenses
You retain ownership of content you submit, subject to the rights of others. To operate the Service, you grant us a worldwide, non-exclusive license to host, reproduce, process, transmit, display, and distribute your content solely to provide, secure, and improve the Service and as described in our Privacy Policy—including processing through AI systems and subprocessors as needed to fulfill your requests.
You represent that you have all rights necessary to submit your content and to grant this license. You are responsible for backing up important content; we are not a dedicated archival service unless expressly offered.
AI outputs and disclaimers
AI-generated outputs may be inaccurate, incomplete, or biased. The Service does not provide legal, medical, financial, or professional advice. You are solely responsible for reviewing outputs and for how you use or publish them.
You must comply with applicable laws and platform rules regarding labeling, disclosure, or restrictions on synthetic media where required in your jurisdiction or on third-party networks.
Third-party services
The Service may integrate with third-party platforms, payment processors, model providers, and other services. Those services are governed by their own terms and privacy policies. We are not responsible for third-party availability, actions, or data practices beyond our reasonable control.
Fees, credits, and taxes
Paid features, subscriptions, credits, and usage-based charges are described at purchase or in your account. Fees are non-refundable except where required by law or expressly stated. You authorize us and our payment processors to charge your selected payment method. Taxes may apply based on your location.
Credits are organized in your wallet as plan credits (included with an active subscription allowance), package credits (from one-time credit packs you purchase), and bonus credits (promotional or complimentary). Plan credits are tied to an active subscription period: when your subscription ends, unused plan allowance is removed from your wallet. Package credits are non-refundable and do not expire while your account remains open, subject to these Terms and applicable law. Bonus credits may expire or carry limits as stated when they are granted.
When a subscription ends or you cancel renewal, paid plan features and limits stop at the end of the current billing period (or immediately if we state otherwise for a specific action). Plan allowance credits stop at the same time and are not refundable. Package and bonus credits you already purchased or received may remain. New subscription allowances and renewal grants stop until you subscribe again.
If you use merchant, gateway, or payout features, additional commercial terms, verification steps, and compliance obligations may apply.
Short links and link lifetime
Short links help you share destinations safely and clearly. How long a link stays available, and which features you can use, depend on your account and plan.
- Without an active paid plan or subscription: each short link you create (including guest links where offered) expires no later than twenty-four (24) hours after creation. Longer or never-expiring options are not available on this tier.
- With an active plan or subscription in good standing: you may create short links with longer lifetimes, including options that do not expire on a fixed date, subject to these Terms, fair use, and any limits shown in your account.
- File destinations (uploading a file to share through a short link) are available only with an active plan. Please do not upload or share files that violate these Terms, applicable law, or the Lawful use and Islamic values guidance—including unlawful, harmful, deceptive, or clearly inappropriate material. You are responsible for what you upload and share.
- If your plan or subscription ends, extended lifetimes, never-expiring options, and file uploads for short links are no longer available under the free tier. Existing free-tier links remain subject to the twenty-four (24) hour lifetime from creation.
- You remain responsible for the destinations you shorten, for passwords and access controls you set, and for ensuring that shared content is lawful and consistent with the Acceptable use and Lawful use and Islamic values sections of these Terms. We may pause, disable, or remove links that create risk, violate these Terms, or are reported in good faith.
Credits, custom codes, and other paid short-link features (where enabled) are billed as described at purchase or in your wallet. An active plan is required for long-lived or never-expiring links and for file destinations.
Maktby intellectual property
The Service, including software, branding, documentation, and our proprietary models and prompts (excluding your content), is owned by us and our licensors. Except for the limited rights granted in these Terms, no rights are transferred to you. You may not copy, modify, or reverse engineer the Service except as permitted by law.
Copyright complaints
We respect intellectual property rights. If you believe content on the Service infringes your copyright, send a notice to our designated contact with: identification of the work, identification of the material and its location, your contact information, a statement of good faith belief, and a statement of accuracy under penalty of perjury (where applicable). We may remove or disable access to material and terminate repeat infringers where appropriate.
Suspension and termination
We may suspend or terminate access if you materially breach these Terms, create risk or legal exposure, or if we must do so to comply with law. You may close your account through available settings or by contacting us. Upon termination, your right to use the Service ceases; we may delete data subject to our Privacy Policy and legal retention needs.
Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MAKTBY AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS.
OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED US DOLLARS (USD $100), EXCEPT WHERE LIABILITY CANNOT BE LIMITED UNDER APPLICABLE LAW.
Indemnity
You will defend and indemnify Maktby and its affiliates against any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your content, your use of the Service, your violation of these Terms, or your violation of third-party rights or laws.
Governing law and disputes
Unless mandatory local law requires otherwise, these Terms are governed by the laws of the country or region where Maktby’s operating entity is registered, without regard to conflict-of-law principles. You agree that the courts located there have exclusive jurisdiction over disputes, except that either party may seek injunctive relief in any court of competent jurisdiction to protect intellectual property or confidential information.
General
These Terms constitute the entire agreement between you and us regarding the Service and supersede prior agreements on the same subject. If a provision is unenforceable, the remainder stays in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger or sale of assets. Notices may be given by email or in-product messages.
Contact
For questions about these Terms, use the contact options published on the Service (such as the Contact page). For privacy requests, follow the process described in our Privacy Policy.
